Spalding County Board of Commissioners voted to fine Coles Corner and suspend the alcohol license for 15 days for the sale of alcohol to someone under the age of 21.

It was the second violation for the store in the past five years and the license could have been suspended for 90 days along with the $1,500 fine. The previous violation was in 2009.

The county agreed to the 15-day suspension, County Commissioner Gwen Flowers-Taylor explained during Tuesday’s hearing, “because we didn’t do what we were supposed to do.”

Edward Bullard, the attorney for the license holder and store owner Pyush Patel, said the county violated the due process rights of the store owner when it illegally took the alcohol license for 15 days, from April 12-26.
